I propose the “New Democratic Charter of United Nations 2013”

Two grueling World Wars were witnessed by mankind.

The World War - I which spanned from 1914 to 1918 and World War II which spanned from 1st September 1939 to 2nd September 1945.This ultimately culminated into formation of “United Nations”.

It has been Constant endeavor of “Mankind” not to remain stagnant in this challenging world.  After 100 Years of World War I, 75 Years of World War II and 68 Years of Birth of United Nations

it is time for us to think progressively.

History and facts of United Nations

To give you a gist, The foundation of United Nations came into being due to the devastated two traumatic World Wars witnessed and suffered by the people of the universe and which ultimately culminated into an unfortunate Nuclear Bomb explosion at Hiroshima & Nagasaki.

In order to curtail any such wars and aggression and in order that people of the universe lead a Life free from such devastated wars, the Super Powers which were the most effected, then decided, created and formed United Nations.

Hence the United Nations Charter was created under such pressure, out of need and threat, that the Charter also used the phrases like “Prevention and removal of Threats”, “Acts of Aggression” or “Breach of peace”, “Settle International Disputes” etc. and this was more a partisan approach of those Nations, as the present Super Powers themselves were primarily responsible for such devastated World Wars.

When the United Nations came into being in 1945 the Total Population of the World was only around 2.55 Billion today it has grown beyond proportion and is around 7 billion people and it is estimated that by 2050 the World Population could be around 9.5 to 10 Billion.

How can the United Nation Charter formed in the year 1946 with world Population at 2.556 Billion can today remain as an effective tool or Charter to serve the interest of the 193 Member Countries?

The needs of the people of the universe have changed over the years. New Culture, trade, social, financial frame work of all Nations have changed.

It is time to completely reconstitute the Charter of United Nations giving Democratic values which has larger working and decision making representation from all Nations in the “General Assembly” collectively and equally.

Let us not sow in the minds of future generation who will be the leaders of tomorrow and will be the protectors of the Mother earth and the Universe, that the UN Charter is used only for settlement of international disputes but to use the Charter for coexistence and enjoy economic, cultural, religious exchanges and protect the interest of Human race to live in harmony without any distinction and discrimination what so ever.

States and Nations must volunteer to settle disputes or disagreement under the umbrella of UN Charter as a tool to peaceful arbitration, understanding and not to use the UN Charter, as a tool for aggression or expression of might.

The Security Council has only 15 Members. Five are permanent Members and they are China, France, the Russian federation, the United Kingdom and the United States. The Non-permanent Members are elected only for a period of 2 years on the basis of geographical representation.

The Security Council under the present Charter of United Nations enjoys a very dominant role. The Five permanent Members of the Security Council also have the powers to “Veto” any resolution or proposal from the General Assembly or within the Security Council. If any of the five Permanent members “Veto” a proposal or a resolution then the proposal or the resolution does not pass.

Hence the decision of the Security Council is vital in every activity of United Nations which in my opinion is not democratic system.

The philosophy and Status of the Five Permanent Members have undergone change. The five permanent Members of the United Nations China, France, Russia, United Kingdom and United Sates as Nations have migrated and changed from its basic status, philosophy and principles from the time United Nations was formed in 1945 till today.

China: migrated from “Republic of China” to “People’s Republic of China”. China's seat was originally held by Chiang Kai-shek's Nationalist Government, known as the "Republic of China". However, the Nationalists were forced to retreat to the island of Taiwan in 1949, during the Chinese Civil War. The Communist government was left in control of mainland China, henceforth known as the "People's Republic of China". In 1971, Resolution 2758 recognized the People's Republic as the rightful representative of China in the UN and gave it the seat on the Security Council that had been held by the Republic of China, which was expelled from the UN altogether. Both governments still officially claim one another's territory. However, only 22 states continue to officially recognize Taiwan's sovereignty.

France reformed its government into the French Fifth Republic in 1958, under the leadership of Charles de Gaulle. France maintained its seat as there was no change in its international status or recognition, although many of its overseas possessions eventually became independent.

Russia: migrated from “Union of Soviet Socialist Republics” to Russian Federation. After the dissolution of the Soviet Union in 1991, Russia was recognized as the legal successor state of the Soviet Union and maintained the latter's position on the Security Council.

United Kingdom after the formation of United Nations: The rise of nationalism in the colonies coincided with Britain's now much-diminished economic position, so that a policy of de-colonization was unavoidable. Independence was granted to India and Pakistan in 1947. Over the next three decades, most colonies of the British Empire gained their independence.

Many became members of the Commonwealth of Nations. They continue to have their internal focus to solve the Scotland and Ireland issues.

The United States exercises global economic, political, and military influence. Its largest and primary activity being military and arms influence in several countries. The 2008-2012 global recessions United States was largely the cause and it has affected the global economy. For example, persistent high unemployment remains, along with low consumer confidence, the continuing decline in home values and increase in foreclosures and personal bankruptcies, an escalating federal debt crisis, inflation, and rising petroleum and food prices. In fact, a 2011 poll found that more than half of all Americans think the U.S. is still in recession or even depression, despite official data that shows a historically modest recovery.

From the above information you would notice that all the five permanent members have undergone the constitutional and economical changes.

How can the same philosophy which their Leaders had while initiating and forming the United Nations Continue in the present situation. It is presently highly politically influenced. It is only reduced to game of power. The mighty want to become mightier and mightier want to curb the mighty. What is required is freedom of speech without the fear of Security Council. What is required is a Democratic activity.

United Nation requires a newly constituted and completely “New Democratic Charter of United Nations” with larger participation of all nations in the joint function of United Nations for mutual good and coexistence. United Nation requires a very new and dynamic approach as the present system has served its purpose.

The five permanent members of the Security Council were the victorious powers in World War II and have maintained the world's most powerful military forces ever since. They annually top the list of countries with the highest military expenditures; in 2011, they spent over US$1 trillion combined on defense, accounting for over 60% of global military expenditures (the U.S. alone accounting for over 40%). They are also five of the world's six largest arms exporters, along with Germany and are the only nations officially recognized as "nuclear-weapon states" under the Nuclear Non-Proliferation Treaty (NPT), though there are other states known or believed to be in possession of nuclear weapons.

How can all the five members of the Security Council, who are the largest producers of Nuclear weapons, and largest producers and exporters of the world’s most powerful weapons, and in possession of Nuclear weapons can genuinely protect the interest of the world?

The present United Nations Charter has served the purpose as it was framed as per the requirements of the Countries then. Today it is a constitution which is largely a restrictive biased and self-centered charter, which cannot solve the problems of the present times. The activities need to be decentralized. The United Nations should go to the People and be in proximity to understand their needs and function more efficiently and also cut the administrative cost.

How can the five permanent Members of the Security Council who have been the major cause of the financial turmoil can become only deciding factor.

How can all the five members of the Security Council, who are the largest producers of Nuclear Weapons, and largest producers and exporters of the world’s most powerful weapons, and in possession of Nuclear weapons can genuinely protect the interest of the world?

Veto power

The "power of veto" refers to the veto power wielded solely by the permanent members, enabling them to prevent the adoption of any "substantive" draft Council resolution, regardless of the level of international support for the draft. The veto does not apply to procedural votes, which is significant in that the Security Council's permanent membership can vote against a "procedural" draft resolution, without necessarily blocking its adoption by the Council.

The veto is exercised when any permanent member—the so-called "P5"—casts a "negative" vote on a "substantive" draft resolution. Abstention or absence from the vote by a permanent member does not prevent a draft resolution from being adopted.

The salient features of the “Proposed New Democratic Charter of United Nations 2013” and the Changes required are as follows:

A “Proposed New Democratic Charter of United Nations 2013” prepared proposes the following:

Five “Permanent Secretariat” are established One in each of the Five Regions representing the five Continents

The United Nations is to be decentralized and represented through Five Regions representing Five Continents under the proposed “New Democratic Charter of United Nations”.

The five Regions representing five continents suggested are as follows:

  • The African Region
  • America & Caribbean Region
  • Asia Pacific Region
  • Australia & New Zealand Region
  • European and Mediterranean Region.

The five regions to have one “Regional Secretary General” each, to monitor the activities of the respective Region / continent and to be elected by the “General Assembly” as they elect the “Secretary General”.

Each of the Five Regions representing Five Continent shall elect their own Five “Regional Administrative Council” Members, from within the respective countries that fall in each of the five regions. The same need to be ratified by the General Assembly.

Role of the Five permanent Members of the “Security Council” proposed to be re-defined

The “Proposed New Democratic Charter 2013” respects and Salutes the Five Permanent Members of the Security Council in its untiring effort in guiding the functions of The United Nations right from its formation in 1945 till date and protecting the interest and serving the “Mankind”.

As per Article 12, Article 18 and Article 23 of the proposed “New Democratic Charter of United Nations, the role of the “Security Council” is proposed to be re defined as “Council of Patrons”, one each members of the “Five Permanent Members” of the “Security Council” re-constituted as “Council of Patrons” representing China – France – The Union of Soviet Republic – United Kingdom – United States of America be defined and designated as “Permanent Patrons”.

The present Five “Permanent Members” of the Security Council be re-designated and elevated as “Permanent Patrons” of the United Nations should be given one Vote each in the “General Assembly” and an additional “Casting Vote” in case of “tie” to enjoy the Good will of creating the present United Nations, and can enjoy a pride of place in the future “New Democratic Charter of United Nations”.

Role of “Security Council” proposed to be re defined

The “Security Council” is re-designed and re-designated as “Advisory Council”. In order that the “Security Council” re-designated as “Advisory Council” continues to guide the “General Assembly” all the Rules which are part of the present “Rules and Procedure” of the “Security Council” shall be improved and redesigned and “Advisory Council” shall be mentioned where ever “Security Council” has been reflected.

The “General Assembly” shall respect their views, opinion and decision and take a fair and conscious decision. Their opinion shall be circulated by the “Secretary General” to the members of the “General Assembly” before they take a final decision.

As per the Proposed “New Democratic Charter” The “General Assembly” shall take all the decisions and give directions and take suitable actions with regards to the General principles of co-operation in the maintenance of International Peace and Security, including the principles governing disarmament and regulations of armament.

Any questions relating to the maintenance of International Peace and Security brought before it by any member of the United Nations or by a State which is not a member of the United Nations in accordance with Article 35, Article 10 and Article 12 it shall take such decisions and give such directions relating to situations which are likely to endanger international peace and security. The “General Assembly” shall have all the powers to take such decisions.

Role of the “Non-Permanent Members”

As per the Proposed New Democratic Charter the role of the “Non-Permanent Members” of the Security Council which serves only for a term of 2 Years are proposed to be merged with “General Assembly” and are proposed to be discontinued as they will be integral part of the “General Assembly” and all are vested with powers to take collective decision.

Hence as per the New proposed Democratic Charter the role of the “Non- Permanent Members” of the Security Council are proposed to be merged with “General Assembly” as they all are integral part of the “General Assembly” and all are vested with the powers to take collective decision.

The main principle of Human life is to “Live and let Live” through the sentiments of “Words, Thought and Deed” in such a manner that it does not effect and harm anyone on this universe but helps them to coexist in tranquility.

If the present five permanent members of the Security Council had during the end of the Second World War initiated the formation of United Nations it was only with a view to avoid any further wars of this magnitude between them.

The United Nation was not created to uplift Social or economic conditions of the war torn nations but was created more to protect further war between the then Super Powers. It won’t be wrong to mention that it was primarily founded to arrest further war between the Five Permanent members of the Security Council. Hence the five Permanent members had vested interest in creation of the United Nations.

How can the five permanent members of the Security Council alone can take “veto powers” in the present time and control the world order? Today after 68 years of United Nations existence the five permanent members alone are not the only super powers. Many have joined the arms race and have created greater feeling of insecurity amongst nations.

Article 12 of the present Charter of United Nations has given immense powers to the Security Council. The General Assembly cannot make any recommendations with regards to dispute or situation unless the Security Council so requests.

This partisan attitude could be the main cause of terrorism spreading like wild fire across the Universe and has made mother earth an unsafe place to live. A sense of insecurity and a constant fear of more powerful war the world has ever witnessed looms over the 193 permanent members of the United Nations.

The Purposes of the United Nation is to maintain international peace and security. To take collective measures and promote peace, through peaceful co-existence, by Peaceful means to uphold principles of justice and international law by acceptance of the Proposed New Democratic Charter.

To achieve international co-operation in Economic, Social, Cultural or Humanitarian Character, by promoting and encouraging respect for Human Rights and Fundamental Freedom for all without any distinction as to Cast, Creed, Race, Sex, language or religion.

The purpose of United Nations is for the co-existence of mankind and to live in peace and tranquility in their respective Nations. Uphold fundamentals of Freedom for all.

Let us not sow in peoples mind that UN Charter is used only for the settlement of international disputes but use the UN Charter for co-existence of human race in harmony.

Nations must volunteer to settle disputes under the umbrella of the proposed New Democratic Charter of United Nations, by utilizing the Charter as a tool for peacefully arbitration, understanding and not to use UN Charter, as a tool for aggression or expression of might.

The goal should be to arbitrate misunderstanding only through peaceful means to uphold the “Proposed New Democratic Charter of United Nations 2013”.

All nations should refrain from use of force under any circumstances. 

The United Nations no more can function only from one permanent Secretariat situated at United States and requires to be decentralized.

This book is an effort to create “The New Democratic Charter of United Nations” through the eye of a common man who believes in coexistence through greater democracy than autocracy of the rich nations alone.

In fact all solutions are available through Non Violence and arbitration.

In War only innocent people die and you could benefit nothing from that. 

Then, why not “we the people” with greater means think loud and give the future generation to lead a life which is free from poverty, free from nuclear arsenal, free from any discrimination, free from terrorist, giving greater human values and democracy.

In present circumstances the principle of Non Violence is the biggest weapon required to curtail any type of aggression.

The arms race and nuclear weapons would have no meaning when the scope for its use is removed, through the strength of coexistence equal right to all the nations to participate and take decisions which can solve its basic needs.

Scheduled 68th Session of General Assembly to be held on Tuesday 17th September 2013

It is my humble request and I would like to plead, and impress upon His Excellency The Secretary General of United Nations Mr Ban Ki Moon, 193  Permanent Members of the  United Nations, The Five Permanent Members of the Security Council, the Non Permanent Members of the Security Council, The president of the 68th Session of General Assembly, The president, Registrar and Honorable Judges of the International Court of Justice, to kindly Propose and Place my Book “Proposed New Democratic Charter of United Nations 2013” for “Debate” and “Discussion” on the Floor of The House of the “General Assembly” at the forth coming 68th Session of the “General Assembly” which is proposed to be held  on 17th September 2013. His/ Her Excellency representing 193 Countries at United Nations, I plead kindly place the book through your good office on the floor of the House at the 68th  Session of the General Assembly of United Nations..It would be a very bold and healthy decision. It would be yeomen service to”Mankind". The book is unbiased and very healthy to all solutions.

Let us “Unite” to Change

Let us all unite and take a solemn oath that we the citizens of the Universe shall truly bring about CHANGE in the world order and create a NEW DEMOCRATIC UNITED NATION with greater universal participation, without any discrimination of caste, creed, race, sex, religion rich or poor.

The Value of Might shall replace Co- existence, harmony, equal human rights and eradicate any racial discrimination from the face of the Mother Earth.

I bow to the world leaders and plead with true humility that now is the time to create “New History” for the benefit of the Future Generation to inherit. Let them boast of its fore fathers leaving behind a Safe, Clean, United, Healthy, free from Poverty and a Beautiful UNIVERSE TO LIVE.

I hope my effort can sow new seeds of new World Order Creating and motivating World Leaders to once again look at the constitutional frame work of the “Present Charter of United Nations” and Change and “create and accept the proposed “New Democratic Charter of United Nations”

I am attaching herewith the amended proposed “New Democratic Charter of United Nations 2013” from an ordinary citizen point of view and hope the proposed New Democratic Charter will be presented to the General Assembly for adoption.

All the proposed Amendments and explanations of the proposed Democratic Charter of United Nations and proposed amendments of its Articles, Rules and Procedures are my own interpretations based on my own understanding, work and in my own words not influenced by any person what so ever. As the work has spanned over period of five years of hard work and represents my own interest of the subject, perception and understanding of the United Nations and activities of its organs.

Let me assure you that the voice of an ordinary citizen can also change the order of United Nations and benefit the people of the Universe.

I shall be glad if I get an opportunity to “address” the August House of “General Assembly” and once again “Propose the New Democratic Charter of United Nations 2013”.

I have unfortunately exhausted all my monitory resources and hence I have no choice but to create this website for easy, effective and faster communication to all the Members of United Nations.

This website will also help all the citizens of the World to read and also if required and if they feel justified, give their views in the blog provided in this website and impress upon the Members of the United Nations to place the “Proposed New Democratic Charter of United Nations 2013” for Debate and Discussion at the 68th Session of the General Assembly.
